We’re pleased to announce another traffic court victory for our client in West Seneca Town Court, Erie County, New York. Our client, was issued a uniform traffic ticket and promptly pleaded not guilty. As part of our defense strategy, we filed a timely request for a supporting deposition pursuant to Criminal Procedure Law § 100.25(2).
Although the Court properly ordered the officer to provide the supporting deposition, the People failed to comply with that order. As a result, the court agreed with our position and dismissed the traffic ticket in its entirety on May 9, 2025.
This dismissal was grounded in long-standing New York case law, including People v Tyler, 1 NY3d 493 (2004), which holds that failure to serve a supporting deposition after proper demand warrants dismissal of the accusatory instrument.
