In a recent victory in Brewster Village Court (Putnam County), our firm secured the complete dismissal of a speeding charge after the prosecution failed to provide a supporting deposition required under New York law.

This result was achieved by David A. Arpino, Esq., who successfully litigated the motion to dismiss on behalf of the client.


The Charge

Our client was charged with Speeding under Vehicle and Traffic Law § 1180(d) in Putnam County.

Although many drivers view speeding tickets as routine, a conviction can lead to:

  • Potential license consequences for repeat violations

The Legal Issue

Under New York law, when a driver charged by simplified traffic information makes a timely request for a supporting deposition, the police officer must provide one within the statutory time period.

In this case:

  • A timely written request for a supporting deposition was made on February 11, 2026;
  • The officer did not provide a supporting deposition roadside;
  • And as of the filing of the motion, no supporting deposition had been served on defense counsel.

Our motion argued that this failure rendered the simplified traffic information facially insufficient under CPL §§ 100.40(2), 170.30(1)(a), and 170.35(1)(a).


The Result

The court granted the defense motion and dismissed the speeding charge in full.

Final Outcome:

  • ✅ Speeding ticket dismissed
  • ✅ No points
  • ✅ No fines
  • ✅ Driving record protected

Why Supporting Depositions Matter

A supporting deposition is not a technicality, it is a statutory right. These documents are intended to provide drivers with factual allegations supporting the charge against them. When law enforcement fails to comply with those requirements, dismissal may be required by law.
