We are pleased to share another successful result achieved by our firm at the Kings County Civil Court.

Our client had been fighting for years to vacate a default judgment entered against him over a decade ago. This judgment, stemming from an alleged motor vehicle accident, had serious consequences — including the suspension of his driver’s license. Despite filing three separate pro se (self-represented) Orders to Show Cause to vacate the judgment, the client was unable to obtain relief.

Recognizing that he needed professional assistance, the client retained our firm in October 2024. We immediately filed a new, comprehensive Order to Show Cause, supported by clear evidence that our client had never been properly served with the lawsuit. At the time service was allegedly made, our client was incarcerated out of state, making personal service impossible under New York law.

The Court granted our Order to Show Cause and scheduled a traverse hearing to determine the validity of service. At today’s hearing, the plaintiff failed to appear. As a result, the case was finally dismissed.

With the dismissal of this action, the judgment against our client has been vacated. Most importantly, this victory clears the way for our client to have his driver’s license restored, putting an end to years of hardship caused by this improperly entered judgment.

This case highlights the importance of diligent, strategic legal representation — and shows that even seemingly long-closed matters can sometimes be successfully challenged with the right approach.
